Dear Magistrale user, The terms of sale given below embody the conditions and procedures through which you may purchase products on the magistralecyclingcoffee.cc website. Please read them carefully and you are requested to accept them in order to be able to use all our on-line services. We reserve the right to change the terms of sale. Any new rule shall take effect from the date in which it will be published on our web site and shall refer to sales made from that moment on.

Registration
You will need to register to be able to access some services on the magistralecyclingcoffee.cc website (our “site”). When you register your details online, it is your responsibility to ensure that the information provided is accurate and up to date. You are also responsible for maintaining your personal information via your online account as well as for keeping your password secret.

The collection and storage of personal information submitted to Il Magistrale Cycling Coffee is governed by the Dutch Algemene Verordening Gegevensbescherming (AVG, 2018) or the EU General Data Protection Regulation (GDPR) and by our Privacy Policy. Whenever you visit the site, or register your details or purchase from the site, you agree to be governed by these Terms & Conditions and by our Privacy Policy

Ordering
When you place an online order through the site, you will be requested to provide personal and payment details. As part of the online transaction, we will perform a fraud credit check via our payment provider Mollie. By submitting a payment through the site, you are granting permission for us to carry out such checks via Mollie as required.

Orders on the site are subject to the required stock availability. Items added to your basket on the site will not be reserved for you, and are available for sale to other customers browsing the online store at the same time.

When you have placed your order via the site, stock will be reserved for your purchase. However, sales will not be finalised until the order dispatches from the warehouse, and payment is successfully taken.

Subscription orders
Our subscription offer is a recurring (incasso) transactional agreement between Il Magistrale and the customer (inhabitant of The Netherlands) to ship on periodic base for a longer undefined period of one selected coffee type as agreed per individual agreement.The individual recurring agreement is activated when the customer pays for the first subscription transaction with the offered payment methods. With this first subscription payment the customer agrees and authorizes Il Magistrale to make future payments collections via SEPA-authorisation with the customers provided bank account.
Payment has to be finalized within 14 days after the agreement was established. Periodic payments will take place in the shipping week. When a timely payment is not received, for example a payment reversal (stornering) of the to deduct amount or temporarly unsufficient cash balance, Il Magistrale is entitled to bill the legal trade interest rate. In the case that the customer fails to pay the due amount, Il Magistrale is entitled to activate a collection agency and to block the services for the concerned customer. The juridical and exceptional costs of this operation will be billed to the concerned customer.
Invoices and payment reminders will be offered to the customer by Il Magistrale only electronical. The personal data provided by three customer are leading.

Pricing
All site pricing will be shown in local currency where available, and otherwise priced in Euros (EUR). Orders can only be placed in the currency relating to your shipping country, and we are unable to offer alternative currency pricing to any customer.

All EU pricing is shown inclusive of tax.

Sale pricing adjustments
From time to time, Il Magistrale Cycling Coffee will run extra beanification points on specific items as part of a sale or promotion. Please note that we are not able to offer any refund when the item (inc. size) is not in stock on the site at the time of the request, or if the item was originally purchased with more beanification points.

In case of obvious misuse of our offers, such as vouchers and promotion codes, the Web Shop reserves the right to cancel the order in question.

Payment & Order Acceptance
We accept the following payment types on our site:

Payments for all orders are taken on dispatch of goods, and are subject to fraud checks and checks by the card issuer.

By submitting your order on our site, you are confirming that the credit/debit card is yours or that you have authority from the cardholder to make the payment. We reserve the right to refuse payments & orders for customers who are not 18 years of age or older.

We will process your payments securely via the Mollie payments system, and all payment details will be encrypted. All stored card details will be stored securely on Mollie's secure servers.

Your payment and order will only be deemed as final when final payment is taken on dispatch of your goods. We reserve the right to refuse any payments or cancel orders at our own discretion.

Delivery
We always aim at delivering your order as soon as possible. Normally orders of items in stock ship within 2 business days from Order Confirmation and can be expected to be delivered to you within five business days. Delivery times are estimates only and particularly during high season (e.g. Black Friday, Social Media sales actions and Christmas) deliveries may take longer than normal. In case of a delay in delivery of more than fifteen (15) business days beyond the estimated delivery time above, you may cancel your order subject to written notice to us, in which case we will, as our entire liability for the delay, credit any payment made by you. If the order has already shipped, you must first return the item to us before such credit can be made. The freight cost will be specified in the order summary before you submit your order. We currently ship to most countries but may not ship to certain countries outside the European Union. Should you have an inquiry as to whether or not we ship to a specific location, please contact us. Please be advised that custom duty may be charged for any orders from outside the European Union. For orders from and shipments to the US, please contact us. You are asked to inspect delivered items upon delivery and report any deviations found as stated under Returns below. In case you fail to collect your products upon delivery, we reserve the right to debit you a charge to cover our cost for return freight and administration.

Right of withdrawal, returns & exchanges
We offer you a “no questions asked” 3-day right-of-withdrawal from your purchase, calculated from the date you order the goods.
If you are not 100% satisfied with your purchase you can return it for an exchange or refund, provided it is within 7 days of receipt of your order and the product shall be returned properly wrapped and packed in their original packaging in unused and saleable condition. We reserve the right to refuse refunds for returned items, which are not in saleable condition.

As soon as we have received the returned items, and have been able to confirm that the requirements above are met, we will refund your payment. In case you find that an item delivered by us to you is defective you should contact us as soon as possible with a formal complaint, to get a replacement delivery or, if that is not possible, a refund. The same applies in case you identify that a product has been damaged during transportation or you identify other deviations in the delivery, e.g. that the number of items or the product model delivered is not in line with your order.

Returns are only accepted online for items purchased directly from magistralecyclingcoffee.cc. If you have purchased your item from an Il Magistrale Caffeine Dealer, you should return the item directly to the Il Magistrale Caffeine Dealer where the item was purchased. For items bought with one of Il Magistrale's retail partners, please contact them directly to arrange an exchange or refund.

In case of a return the risk (for loss or damage during delivery) is on the customer.

Exceptions to the General returns & exchanges policy
Other exceptions

All Vouchers are non-refundable.

Personalised items cannot be refunded or exchanged once an order has been placed. It is the customer’s responsibility to ensure that all details entered for Personalised products are entered.

Intellectual property rights
Usage of the magistralecyclingcoffee.cc site grants you no rights to any copyright or intellectual property rights relating to the content of the site. All copyright is protected under national and international law.

Any site content can only be reproduced or distributed with express permission from Il Magistrale Cycling Coffee.

Personal data
By submitting an order at the Web Shop you consent to us processing your personal data. Your purchase may involve the collection and processing by us of your personal data, for example of the data you fill out in the order form, including your civic registration number as the case may be, or the personal data processing that may be necessary to execute your payment. We will use your personal data to manage your purchase (including with respect to payment, delivery and any returns and/or refunds), for marketing purposes and to improve the services and design of the Web Shop. Your personal data may be transferred by us to certain selected third parties involved in e.g. payment transactions or deliveries, some of which may be located outside the European Union (and which may therefore involve transfer of data to such non-EU countries), but then only to meet our commitments to you in connection with your purchase. We reserve the right to submit your personal data, in whole or in part, as may be required following a mandatory order of the police or prosecutor’s office or by a court of competent jurisdiction or another government agency having appropriate authority, including for the investigation of (suspected) fraud or other crime against you or a third party. Such disclosure will be limited to personal data that are relevant and/or necessary to meet such request and we will do our best to keep you properly informed of any such disclosure.

Your personal data will be stored only for as long as is needed or for as long as is provided by law. Upon your request, we will tell you which personal data about you we are processing and for what purpose(s) and you may request that your personal data is corrected or removed. In case you wish to be removed from any direct mailing lists, please contact us. We will not sell your personal data to any third party for such third party’s marketing campaigns or for any unsolicited marketing unrelated to your purchase(s) at the Web Shop.

Certain products referred to at the Website may not be available in your country. Please contact us for more details about what products are available in your country.  We disclaim liability for any apparent typos on the Website. While we aim at providing as accurate as possible descriptions and images on the Website, there may be minor colour variations between the images and the actual products sold by us, due to a number of factors such as the colour contrast configurations of your internet browser or computer monitor. All pictures are therefore to be seen as illustrations and are not guaranteed to reproduce the exact appearance of a product.

These Terms and Conditions and agreements that are subject to these Delivery Terms and Conditions as well as the establishment, interpretation and performance of such agreements will be governed by Dutch law.
